Open Question: I 140 and priority date question.?

Me and my brother filed our I140 at the same time eb3 our pirority date is december 2004 .my brother tried to speed up the process by moving his documents from nebraska service centre to texas service centre because of the backlogs .however my I140 got approved and i got my work permit and social security and my brothers I140 did not get approved, because while they were moving the documents they misplaced or could not find the labour certificate we have been back and forth with the texas service centre since nov.2008 without any luck now recently i saw a jump in piroty dates In july employment based eb3 was 15AUG03. Now in august employment based eb3 01JUN04. our pirority date is coming close and I am worried for him since he has not gotten his I140 approved if his piroty date is passed and I140 not approved yet. how will this affect him....
